In compliance with the legislation in force, Denis Bacinschi (hereinafter also the Website) undertakes to adopt the technical and organisational measures required, according to a level of security appropriate to the risk of the data collected.

This privacy policy is adapted to the Spanish and European legislation in force regarding the protection of personal data on the internet. In particular, it complies with:

Record of processing activities

The personal data collected through the contact form of this Website is added to a record of processing activities, for the sole purpose of handling the enquiry or request made by the User.

Categories of personal data

This Website collects only basic identifying data: name, email address, phone number and the content of the contact form message field.

The form is not designed to collect health data or any other special category of data within the meaning of Art. 9 GDPR. If the User voluntarily includes information relating to their health in the contact reason field, that information will be:

  • processed under the medical professional secrecy that protects the data controller as a licensed professional, pursuant to Art. 9.2.h GDPR (preventive medicine or medical diagnosis purposes);
  • used exclusively to respond to the enquiry raised;
  • deleted from the email as soon as the enquiry has been answered, without being added to any other system or file.

Legal basis for processing

The legal basis for processing the data provided through the contact form is the performance of pre-contractual measures at the request of the data subject (Art. 6.1.b GDPR): the User voluntarily initiates contact to request information.

Should the User voluntarily provide health data, the additional legal basis is Art. 9.2.h GDPR (healthcare provided by a professional bound by professional secrecy).

Purposes of processing

Personal data is collected for the sole purpose of responding to the enquiry or contact request made by the User. It is not used for marketing, commercial personalisation or profiling.

Retention period

The data provided through the contact form will be kept for 3 months from the last interaction, or until the User requests its erasure.

If the User has voluntarily provided health data, it will be deleted immediately after the enquiry has been answered.

Recipients of personal data

Personal data is not disclosed to third parties for their own purposes, except to the following data processors necessary for the provision of the service:

  • IONOS (1&1 IONOS SE), as the provider of the email address to which form enquiries are sent. The data is hosted in data centres located in the European Union, so no international data transfer outside the European Economic Area takes place.
  • Vercel Inc., as the host of the Website. Vercel Inc. is based in the USA; the international data transfer arising from the hosting is covered by the European Commission’s Standard Contractual Clauses.
  • Google (Google Ireland Limited), as the provider of the reCAPTCHA service that protects the form against automated submissions. See the following section.

This Website does not use web analytics tools or tracking cookies for advertising purposes. The only third-party technology used is reCAPTCHA, for the security purpose described below.

Form protection: Google reCAPTCHA

To protect the contact form against automated submissions (spam), this Website uses reCAPTCHA v3, a service provided by Google Ireland Limited. reCAPTCHA analyses the User’s interaction with the page to tell humans apart from automated programs, without requiring any challenge to be solved.

For this purpose, reCAPTCHA collects and sends Google device and browsing information, such as the IP address and interaction with the Website. This processing may involve an international transfer of data to Google servers in the USA, covered by the European Commission’s Standard Contractual Clauses.

The legal basis for this processing is the Controller’s legitimate interest (Art. 6.1.f GDPR) in ensuring the security of the Website and preventing abusive use of the form. The use of reCAPTCHA is governed by Google’s Privacy Policy and Terms of Service.

Personal data of minors

Only those over 14 years of age may lawfully give their consent to the processing of their personal data. For a minor under 14, the consent of parents or guardians is required.

Secrecy and security of personal data

The data controller undertakes to adopt the technical and organisational measures required, according to the risk level of the data collected, to ensure its security and confidentiality, and to notify the User without undue delay of any security breach that may entail a high risk to their rights and freedoms.

Rights arising from processing

The User may exercise before the data controller the rights of access, rectification, erasure, restriction of processing, portability and objection recognised in the GDPR and the LOPD-GDD.

Use of the Website implies acceptance of this Privacy Policy. Denis Bacinschi reserves the right to modify it; the User is advised to review this page periodically.
